These Terms of Service (“Terms”) govern how we operate and offer, and how you access and use, our website located at https://baltimorecountycourt.us, along with the associated products, services, data, information, content, and materials made available through or in connection with the Website (collectively, the “Services”).

If you are accepting these Terms on behalf of a legal entity other than yourself as an individual, including a business, trust, or government entity, you represent and warrant that you have full legal authority to bind such entity to these Terms.

PLEASE CAREFULLY READ THESE TERMS. YOUR USE OF THE SERVICES CONSTITUTES YOUR ACCEPTANCE OF THESE TERMS. DO NOT USE THE SERVICES IF YOU ARE UNWILLING OR UNABLE TO BE BOUND BY THESE TERMS.

By using or visiting the Services, you agree to be bound by these Terms, including the Binding Arbitration Clause and Class Action Waiver described in Section 12, and the Privacy Policy, which is incorporated herein by reference.

We reserve the right to change, modify, add to, or otherwise alter these Terms at any time. Any changes shall be effective immediately upon posting on the Services. You agree to review these Terms periodically. Your continued use of the Services following the posting of any changes constitutes your acceptance of the revised Terms.

1. Services

The Services allow users to search, access, and obtain information relating to real property and real estate records compiled from publicly available, licensed, and third-party sources. Depending on the search performed, the Services may provide information that includes, without limitation:

  • Property ownership and transfer history
  • Parcel identifiers, assessor data, and lot characteristics
  • Property attributes such as size, structure type, and zoning classifications
  • Property tax assessments, tax delinquency status, liens, and foreclosure-related records
  • Recorded documents, filings, or publicly available legal references associated with a property
  • Market-related data, automated estimates, or other informational indicators

We do not originate, create, maintain, or independently verify official property records. The Services compile and present information obtained from third-party sources for informational purposes only.

We grant you a personal, limited, non-exclusive, revocable, non-transferable license to access and use the Services solely for your personal, individual, non-commercial, and non-automated use. You may not access or use the Services for any commercial, resale, bulk, automated, competitive, or revenue-generating purpose.

The Services may contain links to affiliated or third-party websites. Such websites are governed by their own terms and policies, and BaltimoreCountyCourt is not responsible for their content, accuracy, or practices.

2. Prohibited Uses

In addition to other prohibitions set forth in these Terms, you are prohibited from using the Services or Content, directly or indirectly, for any unlawful, fraudulent, misleading, deceptive, abusive, automated, or commercial purpose, including, without limitation:

  • (a) violating any applicable international, federal, state, provincial, or local law or regulation;
  • (b) submitting false, misleading, or incomplete information;
  • (c) impersonating any person or entity or misrepresenting your affiliation;
  • (d) scraping, crawling, harvesting, indexing, or systematically extracting data;
  • (e) using bots, scripts, spiders, data mining tools, robots, or automated systems;
  • (f) attempting to infer or derive sensitive personal attributes or private facts about individuals;
  • (g) reselling, sublicensing, redistributing, or otherwise exploiting reports or data;
  • (h) circumventing access controls, usage limits, or security features;
  • (i) interfering with or disrupting the Services or related networks;
  • (j) uploading or transmitting malware, spyware, ransomware, or malicious code;
  • (k) engaging in unauthorized framing, linking, or mirroring of the Services;
  • (l) compiling or aggregating data into a database, directory, or dataset without written permission;
  • (m) using the Services as part of any competitive analysis, commercial enterprise, or revenue-generating activity;
  • (n) reverse engineering, decompiling, or disassembling any portion of the Services or software;
  • (o) engaging in conduct that violates these Terms or the Privacy Policy.

BaltimoreCountyCourt reserves the right, but does not undertake the obligation, to monitor your volume and purpose of use of the Services and may restrict, suspend, limit, or terminate your access at any time for any reason, including if we determine, in our sole discretion, that your use exceeds permitted personal use or violates these Terms or applicable law.

3. Intellectual Property

All content, features, and functionality available through the Services, including text, graphics, layouts, designs, compilations, software, code, interfaces, and the selection and arrangement thereof (collectively, the “Materials”), are owned by BaltimoreCountyCourt or its licensors and are protected by U.S. and international intellectual property laws.

You may download and print Materials solely for your personal, non-commercial use, provided that you do not modify the Materials and retain all proprietary notices. Any other use, including reproduction, redistribution, publication, republication, display, transmission, or commercial exploitation, is strictly prohibited without prior written consent.

All trademarks, service marks, trade dress, and logos displayed through the Services are owned by BaltimoreCountyCourt or its licensors and may not be used without prior written permission.

4. Public Records Disclaimer

The Services provide access to information derived from publicly available records and third-party sources, including county, municipal, state, and private data aggregators. BaltimoreCountyCourt does not control, maintain, or update official property or land records.

Property data may be incomplete, inaccurate, outdated, misindexed, subject to recording delays, clerical errors, jurisdictional differences, or subsequent amendments. The Services are not a substitute for official land records, title searches, surveys, or professional legal, tax, or real estate advice.

You are solely responsible for verifying any information obtained through the Services with appropriate governmental authorities, title companies, surveyors, attorneys, or licensed professionals.

BaltimoreCountyCourt is not affiliated with any federal, state, county, or municipal government agency.

5. Links to Third-Party Sites

The Services may contain links to or integrations with third-party websites and services. BaltimoreCountyCourt does not control and is not responsible for the content, accuracy, policies, or practices of third-party sites. Your interactions with third-party websites are governed by their respective terms and policies.

6. Security

We use commercially reasonable administrative, technical, and physical safeguards designed to protect information processed through the Services. However, no security system is impenetrable. We do not guarantee absolute security and are not responsible for unauthorized access, disclosure, or misuse of information beyond our reasonable control.

7. Disclaimers

The Services are provided for informational purposes only. We do not guarantee that information available through the Services is accurate, complete, current, or applicable to your specific circumstances.

You assume all responsibility for evaluating the accuracy, completeness, and usefulness of any information obtained through the Services and for any decisions or actions taken in reliance on such information.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BALTIMORECOUNTYCOURT SHALL NOT BE LIABLE FOR SERVICE INTERRUPTIONS, TECHNICAL FAILURES, OR SYSTEM ERRORS, OR FOR ANY DAMAGES ARISING FROM USE OF OUR SERVICES OR RELATED INFORMATION. USE OF THE SERVICES IS AT YOUR OWN RISK.

NEITHER BALTIMORECOUNTYCOURT NOR ITS AFFILIATES OR REPRESENTATIVES SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OF DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTHING IN THIS SECTION LIMITS LIABILITY WHERE PROHIBITED BY LAW

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).

10. Indemnification

You agree to indemnify, defend, and hold harmless BaltimoreCountyCourt and its affiliates, officers, directors, employees, agents, licensors, and data providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of (i) your use of the Services, (ii) your violation of these Terms, or (iii) your violation of applicable law or the rights of a third party.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to conflict-of-laws principles.

12. ARBITRATION CLAUSE AND CLASS ACTION WAIVER – IMPORTANT

PLEASE READ THIS SECTION CAREFULLY AS IT AFFECTS YOUR LEGAL RIGHTS.

Except for Exempt Claims, any dispute or claim arising out of or relating to the Services or these Terms will be resolved through confidential, binding arbitration, rather than in court. Before arbitration may be initiated, either party must provide written notice of the dispute and allow thirty (30) days to attempt informal resolution. Notices must describe the nature of the claim and the relief sought and be sent to 1070 Montgomery Rd #2024, Altamonte Springs, FL, 32714.

If the dispute is not resolved, arbitration will be administered by the American Arbitration Association (AAA) in accordance with its applicable consumer rules and governed by the Federal Arbitration Act. Arbitration will be conducted in Massachusetts or another mutually agreed location, and for consumers, at a location reasonably convenient to the consumer. Claims of $10,000 or less may be resolved by written submissions or a telephone hearing.

The arbitrator may award any relief available in court, will apply Massachusetts law, and may decide issues relating to the interpretation or enforceability of this provision. The arbitrator’s decision will be final and binding, with limited rights of appeal as permitted by law.

Claims must be brought on an individual basis. Both parties waive the right to a jury trial or to participate in any class or representative action.

Exempt Claims

  1. This provision does not apply to: (i) Individual claims brought in small-claims court, or (ii) Claims seeking injunctive relief to prevent intellectual property infringement, which may be brought in court.

Opt-Out and Time Limit

You may opt out of this arbitration provision by providing written notice within sixty (60) days of agreeing to these Terms to: BaltimoreCountyCourt, 1070 Montgomery Rd #2024, Altamonte Springs, FL, 32714; include your name, address, and date.

13. General Provisions

Entire Agreement. These Terms constitute the entire agreement between you and BaltimoreCountyCourt regarding the Services and supersede all prior agreements.

No Agency. These Terms do not create any agency, partnership, employment, or joint venture relationship.

Severability. If any provision is held unenforceable, the remaining provisions will remain in full force and effect.

No Waiver. Failure to enforce any provision does not constitute a waiver of that provision or any other.

Statute of Limitations. To the extent permitted by law, any claim relating to the Services must be filed within one (1) year of accrual.
